Court hearing with NO legal representation

I am an ‘affected other’. I have been embroiled in a court case. I did not borrow/loan any money, I have never been guarantor, yet the Claimant has added me. Ideally my name should be struck off. There is a Case Management hearing in court on 23rd December. We haven’t got legal representation as we do not have the funds!!  What are my next steps??  Why should I pay out for legal fees for something that is not my debt?!! Been to Citizens Advice, National Debt Line, Support Through Court …… I’m going round in circles and being passed on and on ….. no-one is directly helping me and seeing me through this …. very frustrating….. real help needed ….. the 23rd is just round the corner. Help appreciated.

There are a nr of lawyers online where you can ask a question or two for an affordable fee. justanswer (co.uk) is one of those sites. Maybe they can help you.

You needed to have signed any guarantor forms to be added on as one. People wouldn't be able to just add you on. So something dodgy going on there..

You can only be liable for the debt if u are a joint account holder or guarantor. The only other way u can get into this if u are a joint morgage holder with this person or are on joint bank. The person who they owe the debt to can look for payment from assets.

For example when i went bankrupt they had house valued to see if any profit in it they could have.

The loan company can ask for them to be made bankrupt in this situation to try and release funds for the debt 

If u have no joint assets then your name should not be on the court order at all unless the person has illegally put u down as the guarantor.

You need to contact the loan company to see how your name is involved in this. Have u been added as a joint applicant on the debt or a guarnator against your will?

Its easier these days to fraudulently add people onto a loan at the outset these days with everthing online. You dont have to physically be there or sign a signature on a piece of paper. Its all done by email.

If the court has named u then u have been linked someway to this. Ask the person who got the loan to be honest cos u gonna find out now either way

Get a copy of your credit file. You can see if u joint on this debt or linked. U can do this immediatly. I check mine with total money its free to do this. 

You need copy of your credit file and loan agreement if u not on there. And have no joint accounts or assets with the named debtor they can not include u in this hearing
