Hi

Just thinking worse case scenario for the future....

does anyone know if my husband debts could mean that my house could be risk? I.e. Are debts in his name his responsibility, or because we are married then can someone come and take my home? If so how do I protect my home?

I do not have a mortgage on my home and it was paid off before we met so he's never paid into it and his name has never been on the deeds etc

Hi LLT you can get a legal document drawn up that states that there is nothing of his in the house, he has no ownership. Someone at my meeting has done this. Apparently a huge document but she's done it in case bailiff comes knocking. Also he doesn't contribute just pays for food. Definitely find out from a solicitor. Have you done credit reports for yourself? I'm not the best person as my knowledge isn't as extensive as others. Nothing wrong with looking after yourself!

If he's not on the deed title and the house is soley in your name then they wouldn't be able to touch that and you have the bonus of it having been registered in your name before your marriage took place but items inside the home would be subject to you proving ownership of, ie proof that you'd paid for them otherwise they would be deemed his assets and could be seized unless any loan's or debt's were co signed by yourself of course .

Hi been in same situation house was in my name and even though it was still mortgaged i could protect it by getting husband to sign a legal document to waive any rights to the house. It didnt take long and cost a minimal amount. Even though he had to take out an iva they couldnt touch the house even though they tried.

good luck
